1. Agreement to Terms

By accessing or using LLMTune ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these Terms, you may not access the Service.

These Terms apply to all users, including visitors, registered users, and organizations using LLMTune's fine-tuning, deployment, and AI model management platform.

2. Description of Service

LLMTune provides a platform for:

• Fine-tuning large language models using LoRA/QLoRA and other adaptation strategies
• Deploying and managing AI model endpoints
• Monitoring usage, performance, and costs
• Managing datasets, training jobs, and model versions
• Providing OpenAI-compatible API endpoints for inference

The Service is powered by IO.net compute infrastructure with NVIDIA acceleration. LLMTune operates as an independent platform and is not affiliated with IO.net beyond infrastructure usage.

3. Account Registration

3.1 Eligibility

You must be at least 18 years old and have the legal capacity to enter into contracts to use the Service.

3.2 Account Security

You are responsible for:

• Maintaining the confidentiality of your account credentials and API keys
• All activities that occur under your account
• Notifying us immediately of any unauthorized access

3.3 Account Termination

We reserve the right to suspend or terminate your account if you violate these Terms or engage in fraudulent, abusive, or illegal activity.

4. Acceptable Use

4.1 Permitted Uses

You may use the Service only for lawful purposes and in accordance with these Terms.

4.2 Prohibited Uses

You agree not to:

• Use the Service to generate, distribute, or store illegal, harmful, or offensive content
• Violate any applicable laws, regulations, or third-party rights
• Attempt to reverse engineer, decompile, or extract source code from the Service
• Interfere with or disrupt the Service or servers
• Use automated systems (bots, scrapers) to access the Service without authorization
• Share API keys or account credentials with unauthorized parties
• Use the Service to compete with LLMTune or create derivative services
• Upload datasets containing personal information without proper consent or legal basis
• Use the Service to generate content that infringes intellectual property rights

5. Intellectual Property

5.1 LLMTune Property

The Service, including its design, features, and functionality, is owned by LLMTune and protected by copyright, trademark, and other intellectual property laws.

5.2 Your Content

You retain ownership of datasets, models, and content you upload or create using the Service. By using the Service, you grant LLMTune a limited license to:

• Process and store your data to provide the Service
• Use your data for service improvement and optimization (anonymized where possible)

5.3 Fine-Tuned Models

You own fine-tuned models created using the Service, subject to the licenses of base models and any third-party components used.

6. Billing and Payments

6.1 Pricing

Pricing for the Service is based on usage (compute hours, tokens processed, storage). Current pricing is available on our website and may change with notice.

6.2 Payment Terms

Payments are processed through Stripe. You agree to:

• Provide accurate billing information
• Pay all fees when due
• Authorize automatic charges for recurring subscriptions

6.3 Refunds

Refunds are handled on a case-by-case basis. Training jobs that fail due to Service errors may be eligible for credit or refund.

6.4 Overdue Accounts

If payment is overdue, we may suspend your account until payment is received. We are not responsible for data loss during suspension.

7. Service Availability and Modifications

We strive to maintain high availability but do not guarantee uninterrupted access. We may:

• Perform scheduled maintenance with advance notice
• Modify, suspend, or discontinue features at any time
• Update the Service to improve functionality or security

8. Disclaimers and Limitations of Liability

8.1 Service "As Is"

The Service is provided "as is" and "as available" without warranties of any kind, express or implied.

8.2 Limitation of Liability

To the maximum extent permitted by law, LLMTune shall not be liable for:

• Indirect, incidental, or consequential damages
• Loss of data, profits, or business opportunities
• Service interruptions or failures
• Content generated by fine-tuned models

Our total liability shall not exceed the amount you paid to us in the 12 months preceding the claim.

9. Indemnification

You agree to indemnify and hold harmless LLMTune, its affiliates, and their officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Content generated by your fine-tuned models

10. Data Protection and Privacy

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect your information.

11. Termination

Either party may terminate this agreement at any time. Upon termination:

• Your right to use the Service immediately ceases
• You may export your data for 30 days after termination
• We may delete your data after the retention period
• Outstanding fees remain due

12. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes shall be resolved through binding arbitration or in courts of competent jurisdiction.

13. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be notified via email or through the Service. Continued use after changes constitutes acceptance.
